Industrial Commission Announces Policies Designed to Promote Swifter Decisions and Revised Uniform Pre-Trial Order and Subpoena Form

“The Industrial Commission will be implementing changes designed to responsibly lessen the time required to render decisions in contested cases. Specifically, for all cases in which requests for hearing are filed after July 1, 2014, the Commission will be reducing the mediation timeframe from 6 months to 5 months. Effective July 1, 2014 (regardless of when the request for hearing was filed), the Commission will be utilizing a revised Uniform Pre-Trial Order, a revised Subpoena Form, and will also be implementing two internal policies. The first policy will eliminate unnecessary continuances, and the second policy will require Deputy Commissioners to enter Opinions within 90 days of the close of the hearing record, rather than 180 days as allowed by N.C. Gen. Stat. § 97-84. Links to the revised mediation timeframe, internal continuance policy, and a copy of the revised Uniform Pre-Trial Order (including the revised Subpoena Form) can be found here: Mediation Timeframe, Continuance Policy, and Uniform Pre-Trial Order.”
